My Spouse have visa extended till 2016 with the same employer
and we also match the eligibility criteria for the Visa Interview waiver
program, his recent visa stamped expired in Nov 2013. But the scenario
is like, I and my son accompanied him to US on H4. Later I got the
consultancy to file my H1b and applied for COS but he was not able to
provide me the project, so I was out of status for 4 months and didnt
had any pay stubs. I came to India with my son for Visa stamping on H4
from here. Also my son have valid visa extended upto 2016 as of my
husband. So my Question is can I apply for H4 on my previous H4 visa on
passport through Interview waiver program. My husband have all the
required documents ranging from client letter, LCA, I-129, paystubs,
bank statements, i797, MSA, W2 and many other relevant docs..
