Hello Friends,
Currently I am in US on L1B through company A.
Last Year Company B had filed a H1B through "Consular Process" which was approved but I have not used that petition and visa was not stamped for that petition. I didn’t join company B as they lost the position and currently they don't have any projection. Now they have Revoked/Withdrawn that approved H1B petition.
Meanwhile a new employer, Company C is ready to hire me and sponsor my H1B visa.
1) Can Company C uses that previous Revoked/Withdrawn H1B petition to apply a new H1B COS (L1b to H1b) exempt of cap FY2015?
2) I don't have the Approval copy of the old H1B petition and I just have the Petition receipt notice(I 797C) copy. Is it possible for Company C to apply a new H1B exempt of cap FY2015 without the Approval copy and just with the Petition receipt even though it’s Revoked/Withdrawn?
