  • H1B - after being Selected in April 2014

    Hello All,

    I was chosen by USCIS in the last H1B lottery. I have several questions. Thanks to help

    1- What is the max time in which I can keep USCIS letter before going US Embassy to stamp my passport

    2- What is the max time in I can stay in my country before travelling US to my employer

    3- I need like to have 12 months before going to US and I agreed with my employer, so it is better to wait in my country 12 months then go , or go to US and sign contract and do some kind of paper work and come back to my country then later on goto US to my employer

    4- How can I take un-paid leave outside US (requirements & steps )?

    5- Can I work from home while I am located outside US?

    Have you got the approval notice already? Did you pay for your own H1? When you say last H1 lottery do you mean the one that happened in April 2014 or April 2013?

    1. Once you are cap counted you can choose to remain cap exempt for 6 Years.
    2. No Max time to stay in your country, after all its your country, but in case you want to work with the employer in US, you have to go for visa stamping within 6 Years of being cap counted.
    3. Your employment with the US employer begins only while you are in US.
    4. Same as above. So it doesn't matter what you do outside US, whether get paid or not leave or no leave, it would be governed by the employment contract. But if you are in US you have to get paid.
    5. How and where you work while outside US doesnt matter to USCIS.

      Yes I paid for my H1 the approval will come within days yes April 2014
