    Hi,
    my situation is as follows :

    1. I have H1B EXTENSION petition (applied at time of leaving USA) which is revoked by USCIS as i had returned to India when they visited client place after approval.
    2. My company A has applied for new visa extension - cap exempt
    3. i have travelled to USA before on previous petitions . i have stamped visa which is expired now.

    4. i want to change my company from A to B in India.

    Q :

    1. can company B apply for new petition - cap exempt ( same as applied by my current company A) OR will i have to wait for new petition applied by company A to be approved
    2. what do i need to submit to company B for the same

    Hello, Anuj.

    Yes. Company B can file an H1B transfer petition for you. The process is same, just that this will be a cap exempt petition (you have not provided dates, but i am assuming your visa is not expired). Company B will need your old I797 approval details - their attorney will know what to do, actually.

    So, your transfer is possible.

      My visa is expired as of now.
      My petition extension which was applied when in US has arrived but it was revoked by USCIS
      New petition extension has been applied
