H-4 and Divorce
Hello all,
I need your advice on the following.
I am on H-4 visa as a dependent to my husband, who is on H1B. Too, my potential employer filed for my H1B on 04/01/2014, I am waiting for USCIS decision.
We have a daughter, minor, born here in the U.S. I recently filed for divorce with my husband as he was abusing me. The first divorce hearings date assigned is in August 2014.
Questions:
1. Can my husband's employer (the petitioner for his H1B and my H-4) ask USCIS to revoke my H-4 ?
2. After the divorce is finalized on certain date, will I be out of the H-4 status and have to leave the U.S. (if my H1B is not approved before) ?
Is there any way for me to stay in the U.S. after the divorce if the child custody will be given to me ?
3. Will my loss of H-4 status have an impact on who will receive the custody for our child ?
