  • H1B Transfer - gap between jobs

    Hello,

I am currently on H1B visa with company A. I got a job with company B and they are filing my H1B transfer petition next week. I came to know that, I can switch employers as soon as USCIS receives the application.

I want to take break of 2-3 weeks between the jobs as I have to relocate and set up things at the new place. Also, I want to quit my current job with company A as soon as possible.

    1) So, can I quit my current job immediately after USCIS receives the application and take this break of 2-3 weeks ?

    2) In case I can take this break, what will be my status during this period ? As I will not be getting paid during this period, should I take health insurance for this period ?

    Thanks

1/You can quit company A as soon as USCIS receives company B filing. However, you are not allowed to "take a break."
2/ You would be out of status, which is why you should not take a break.
