L1 to H1

Hi,

I was on L1 and i filed COS to H1 and it has been approved. My wifer had an L2 till now with a EAD and she use to work, My question is can she still continue to work till Oct 1 or she gets converted to H4 from the date the decision was made on my case? I am asking because H1 is applicable from Oct 1 but i am not sure how it works in case of COS.

Did you/your employer also file a L2 to H4 for your spouse?

If your L1 I-94 and her L2 I-94 is valid till 30-Sep-2014 or beyond then you would automatically move to H1 status from 01-Oct-2014.

She would not move to H4 automatically unless you have applied a L2 to H4 COS for her. File a L2 to H4 Change of Status for her before 01-Oct-2014.
