I know this question has been asked before, but I want to make sure this fits my current circumstance.
I was employed at Company A on my OPT status. Company A filed for my H1b which got approved in May 2014.
Then, I got a much better job from company B. I quit Company A in June 2014 and am currently working at Company B on my OPT status.
Company A then revoked my H1b approval. I'm still on my OPT status. I received my H1b approval notice but my visa was never stamped since it's before October 1st.
Can Company B sign up for a cap-exempt H1b application using the fact that my H1b was once approved (but then was revoked)?
I've read conflicting info about this.
One person says once I've been approved, I am eligible for cap-exempt application for the next 6 years.
Another person (who is an attorney online) says since the h1b was revoked before October 1st, my approval goes back to the pool and I am not eligible for the cap-exempt.
Please help!
