  • Benefits of two approved petition

    Hi All,

    I have two approved H-1b petition from different employers.
    How can I used them and what is the benefits of having two approved petition. Appreciate your guidance here.

    Well , you can work for only one employer at a time, unless the petitions were filed as "concurrent" which I assume they were not. And each petition's validity is 6 Years cap exemption provision.

    I dont see much benefit in having two petitions. In my personal opinion it was only a wasted petition which could have been potentially used for some one who missed the lottery.

      I need you suggestion on this following.

      Two employers A and B filed petition for me. Petition for A has been approved but B got critical RFE. Now, B is asking me to pay some fees in order to prepare documents and respond to RFE.

      I'm confused and need your suggestions what should I do ?

      1. Should I pay B and get the 2nd petition approved ?
      2. Is it safe to have 2 petition ?
      3. Can I use one petition in future if any issues with employer ?
      4. Do you think of any benefits which I can availed by having two petitions ?

        Did you pay for B's petition? Any particular reason why you want to join B over A? I would not recommend sticking with an employer who is asking you to pay to respond to the RFE.

        1. Whats the guarantee that if you pay the RFE will be responded to and the petition will get approved? Don't fall for such things.
        2. No harm in having 2 petitions, but as I said it hardly helps.
        3. You can use the approved petition itself.
        4. None to my knowledge.

          Unfortunately...yes... I paid the full fees to B but I didn't pay anything to A. The only reason was the lottery thing, I was afraid whether I would get picked up or not but I got lucky and selected for A and B.

          I wanted to pay to RFE and get it approved becuase I was thinking that since I paid the fees so I should have the approved petition so if any issue in future ... I can use it.

          Do you think...its worth to pay and have both approved petition so can be used it in future when required ?
