Re-enter into USA before 1 month of Visa and I-94 expiry

Hi,

My H1B, I-94, my family's H4 and I-94 all are valid till jan-2015.


I need to go out of USA in Nov-2014 and come back in Dec-2014 (i.e. before my visa gets expired. Since my visa expiry date would be less than a month, at the time of POE would there be any restriction/problem on getting the new I-94 with expiry date same as my visa expiry date (i.e. Jan-2015).


Note: my employer would file the H1B extension through Premium Processing in Dec-2014 once i am back from my vacation.

No problem ,but u will get I-94 only till JAN 2015
