Hi,
I moved to my current employer in 6/2012 and got an I-129 from them. It is valid until 6/11/2015. I have my H1B stamping for my previous employer(haven't visited India since I moved to my new employer). That H1B stamping has expired on 9/30/2013. I am planning to travel to my home country in Oct-November 2014. I understand I will need to get another H1B stamping for my current employer. I have two questions in this regard-
1. Will it be an issue when I go for stamping in November 2014 since the i-129 from my current employer is valid only until 6/11/2015 (less than 1 year from stamping date)?
2. On the DS-160 should I put my intended duration of stay as 1 year (given that my I-129 is only valid until 6/11/2015)? I will be eligible to renew my petition in June 2015 for one more year (since my original petition was starting in 2010 and H1B will max out in 2016), so should I put the intended duration of stay for 2 years? If the Visa Interview officer asks me how long I will stay in the US, should I say 1 year and also add that I am eligible to extend for one more year (until 6/2016)?
Please advise.
