Clarification on Non-cap category

Hi,

I had a H1 B visa which was issued to me in 2008 and was valid till late 2011, unfortunately due to various reasons I could not visit US and hence went unutilized. I got to know that there is an option that I could file for a H1B visa again freshly and would not fall under the capped category. Can anyone let me know how this process works and how long I will be falling under the non-cap category.

Once cap counted on H1 if not used within 6 Years will lapse.
