I'm on H1B since 2012. Originally my H1B was valid for 3 years. Now my employer changed, and they told me they'll need to submit client SOW for every visa extension. They'll only request extension until the SOW end date. That means with short SOWs (3-4 months), I'll have to extend the visa multiple times per year.
Now I'd like to understand what the requirements for this extension approach are. I'm a consultant, so I work on site at clients; however I'm still "in control" of my own employer, they have a manager on site too, they decide hire/fire, they set my salary. But I'm on site at the client and work with client personnel and our own personnel.
What is the trigger that causes the client SOW requirement? What could be changed in the described setup so that it's not required to provide client SOW?
For example, is it that I'm 100% onsite, or is is that I'm working 100% for clients, and it would be sufficient to add some % in-house duties to that.... Just some ideas. I'm curious what you know.
