I came to USA on L2 Visa and then changed to H1B. Now my H1B is expiring and I have applied for extension. Got RFE for extension. I would like to know what are my next options if H1B extension is denied. Below are my details.
Entered USA in 2012 and got I94 till Oct,2015.
Applied H1B in 2013 and got approved for 1 year. H1B end date is Sep,2014.
In the approved H1B I didnt receive any new I94 and its the same number as L2 I94.
My first question:
How long is my I94 valid? Is it still Oct,2015 or Sep,2014. When I check the I94 status on USCIS website, it is showing Sep,2015.
But as my H1B petition is expiring by Sep,2014. So after Sep,2014 what will be my status considering my H1B extension is denied.
Is it like I am out of status with a valid I94 ?
Second Question :
If extension is denied and if I apply Change Of Status after Sep,2014. Do I need to leave the country?
Please advice.
