H1B Petition Expired and remain unused. Do i go for new petition or transfer petition

Hi ,

I was issued H1B in Oct, 2009 and it got expired in Sep, 2011. I never traveled US on H1B and my H1B petition is going to complete 6 years this Sep, 2014.
I have 4 questions on my H1B petition.

1. Am I Cap Exempt ?
2. Is my petition still valid?
3. If any US company is willing to hire me, do they need to file new petition or transfer petition?
4. If I get petition, I can stay for 3 years or 6 years at a stretch (with extension)
