  • H1B transfer from University to Company

    Hi,

    I am working in a university and have an academic H1B (non profit).Am I eligible to work in a company if they are willing to sponsor me?
    I ask this because,the company will file petition in April 2015,which only allows to start working in October 2015.Is there anything that can be done so that I can continue working until then,as my academic H1B wont be valid,so I would lose my H1B status.

    Is there any bridge petition to maintain my status?

    No Such bridge petition. If non Profit company is not willing to keep you till Oct 2015, you will have to leave US or find another non profit company.

      No. However, you may file a concurrent H1B Visa with the for-profit company while maintaining your University H1B Visa. In this scenario, you are able to start work for the for-profit company immediately after filing the petition with USCIS.

          One cannot work just after filing the LCA. LCA is filed with DOL and not with USCIS. Unless you are currently in H1B status and a transfer or a concurrent H1B petition is filed, one cannot begin working for the new H1B employer.

          Well, first of all the quota (CAP) for this year is over. You will not be able to file a H1B visa with a 'for-profit' company. You will have to wait until next April to file under a new CAP.
