I need expert advice since I am in real trouble. I was working as a Resident Physician under EAD. I entered US last April(2004) under H4 and my husband applied for an EB1 petition along with I-485 for both of us. From that I got EAD and working till now. On October 6, 2005 we got the denial notice of EB1 along with I-485's. Then our lawyer made an appeal on that last week and waiting for the receipt of the appeal. On Nov 4, 2005, my brother passed away due to a sudden hear attack and I was so shocked and traveled home without thinking anything else.
I also have the advanced parole valid till April 2006, which I obtained based on the I-485. Will I be able to use that advance parole to enter US after my lawyer receive the receipt of appeal for EB1.
Please advice.
