    Hi All,

    Am in some critical situation. Am in H1B visa with Company A. I have got a new offer with Company B and they started filing my H1B transfer.
    Company B starting date will be on September 22nd 2014. I have my notice period with my Company A till September 22nd.

    meanwhile i have got another offer from Company C and they are going to send the offer by September 3rd 2014. Once i accepted the offer from Company C, then they will start transferring my H1B transfer. I liked Company C offer, Pay and role and i wanted to join Company C.

    Can you please clarify this ?

    1) Can i reject Company B offer after they filed my H1B transfer ?
    2) Is there any legal issue since Company B filed my petition on premium mode ?
    3) Can i join Company C once the transfer is done on behalf of Company C ?

    Barring any issues with the Employer B , and any issues with your past status, it seems your petition for company B will most likely be approved by Sept 23rd as its being filed in premium. The question is which employer would you be working with on 23rd Sep onwards? Is C also planning to file the petition in premium?

    If both are filed and approved before your last work day with the current company, I believe you have a choice of joining B or C. If only B's petition is approved, then you have to join B otherwise you risk going out of status.

    One would also have to see if you have signed any contract with B stating if you are liable for any damages if you dont join them.
