  • H1B Deactivation, put on hold, freeze

    Hi,

I’m currently working in NY with an O1 visa (artist visa) but my company applied for the h1b last April 2015 and it was approved. I’m planning to get the h1b visa stamp next Christmas at the American embassy in my home country but I might have to move back to my country probably a month after.

I’ve heard it is possible to freeze/put on hold my h1b in case you want to move back and work in the states again, is this correct? Here are all my questions about it:
    1. How does this work? Is there anything I have to do for freezing the h1b or is my company who has to deactivate it?
    2. If the “freeze” of the h1b exists (I don’t know the term), could only be reactivated by my company or I could work for another company? This will only have to do the regular transfer once the h1b is reactivated?
    3. How can I know if my h1b has been deactivated or not once I’ve left the country?
    4. Is there a minimum/maximum period you can deactivate for?
    5. How does the reactivation work? I have to do it from my home country at the American embassy or it has to do it my old company from the states? Could be done directly from a different company?

Thank you very much for your help in advance!
