H1B Stamped but never used -- Cap Exempt

Hi,

I have my h1b stamped in 2008 but I never travelled to usa.. Will I be eligible for cap exempt ? I have my receipt number... Will any employer be able to apply for me with just my receipt number if I am cap exempt ??

Hi,

Yes u r eligible for cap exempt. Find an employer who can file a new petition.

My approved petition is going to expire by this month end sept 30 2014. It was never stamped,never travelled to usa. If the same employer applies a new petition, Will i be eligible for cap exemption. Please let me know guyys.. If i dont, will book the slot without my client letter.

Hi,

I guess u r eligible for cap exemption. Find an employer who can file u new petition, get the documents (I797,..) and then go for stamping.
