I have a situation where me and my wife both are staying in US. I have a H1B Visa with I94 expiring on jan 20, 2015. I also have my I140 approved. My wife is on H4 visa with me. My wives H1b was applied with Change of status option which is under RFE with decision pending.
Now my 6 years of H1B are getting over on Jan 20. So I need to apply for my H1b extension based on approved I140 I have. Going with extension process would mean that my wife will have another application for her H4 extension with USCIS. So here is my question.
Will applying my extension cause her H1B to be rejected? Or I will it be still considered for approval without COS. If yes to above to questions should I go for my extension without her H4 extension? And is that possible?
I will really appreciate some guidance from learned folks in this forum.
