Had some recent developments over last 2 weeks which I'm seeking advise on.
I am on F2. Got my H1B approved through consultant, (after going through RFE), so approval came only a couple of weeks ago. The consultant firm has not been working to place me and I have been interviewing on my own.
I have an offer with an MNC company, and they are not willing to do corp-to-corp. They have stated that they only want to hire me as a full-time employee. This is a very good opportunity, so I would prefer to do this than start with the consultant.
If there are any delays by a few months, then the MNC offer will no longer hold, so working for the consultant for 3 months and then moving over is not an option.
1. Since it was Change of Status, Am I currently on F2 or H1B status, even though I have not started employment?
2. If I am already considered H1B status, would I be out of status for the entire time that I stay unemployed? Is there a maximum allowed timeframe for me to start work?
3. What documents do I need from the consultant in order for MNC company to either take on the existing petition or apply for a new petition? I only have the original I797 receipt notice from April. What additional paperwork does the new company need to show that I am no longer subject to H1B cap?
4. If consultant refuses to give me necessary documents in (3), then what option do I have?
ETA: If I need to travel out to home country to avoid any issues / violation of immigration, that can be done too. Please advise if that is necessary.
