1. I came to US in 2013 with L1B VISA from employer A
2. Employer B filed my H1B Visa in April 2014
3. My L1B VISA expired in 2014 after filing my H1B
4. Employer A (L1B) has filed my extension
5. I got RFE for L1B Extension
6. September 2014 I got H1B I797 C Notice which says since I was out of Status (L1B Expired) my Status from L1b to H1B can not be changed and I need to go for Stamping.
7. Now my Current Employer A wants to file H1B Cap Exampt
Could you please provide your inputs
1. What are the chances of getting the H1B Cap Exampt petition approved
2. What documents I need to file H1B Cap Exampt petition
3. Is it a good idea to file Cap Exampt or I should first get it Stamped for Employer B as is and then I should go for H1B Transfer for Employer A
I really appreciate your help here as I am not sure what to do and how long I will be here on L1 extention because L1 extensions are getting rejected.
