  • Working on L1 , H1 approved.

    Hi,

    I need a suggestion on the below:

    1) Currently I am on L1 VISA and it is valid till 2016.
    2) I applied for H1 through a Sponsor(not my current company) and it got approved on Sep 29th 2014. ( H1 is valid from oct 1st 2014 to Aug2017)


    so do i need to change my status immediately and work on H1 VISA through my new employer? My employer told that he didn't applied for status change yet and i can work on L1 VISA till the time i get new job on H1.


    so if it is correct , for how many months i can work on L1 VISA with H1 getting approved.

    Few things, if your employer has not applied COS then you are still in L1 status and fine to work with L1 employer till ; L1 I94 /5 Years on L1B/7 Years on L1A ; whichever is the earliest.

    The thing that concerns me is your statement "till the time I get new job in H1" this shows that your H1 employer applied for you without actually having any work for you. This is not a good sign about a genuine employer.

      Thanks for the reply. sorry for not being clear in my statement. My Employer didn't applied for COS as per my request as I will not be able to work on H1 for another 3-4 months due to my personal reasons.

      So I can work on H1 after 3-4 months after my personal commitments are resolved right.

        The H1 employer would first have to file a L1 to H1 COS and I would advise you start work only once the COS is approved that is you get a I797 with new I-94.
