Fellows, I need urgent advice
I am working for company X and planning to travel to Asia for 1 month in December. I have accepted an offer from company Y, but has not resigned from company X. I'm planning to resign after my vacation in January 2015.
My visa stamp will expire this December and I am applying for a new one, under the petition of company X (my current employer). Remember, I will still be working for company X upon my return, but at the same time, my USCIS will probably have received a new I-129 petition when I am traveling.
My question is,
1.) is this a good idea? Technically I haven't resigned, and I am a lawful worker for my current employer.
2.) Will the travel plan effect H1-B transfer decision?
