H1B in 2009 - H4 to H1B tranfer in cap exempt

Hi,

My employer filed for H1B visa in 2009. I resigned the company as we planned to return for good in Aug 2011.

Now I'm going for H4 stamping in 2 weeks and planning to travel to US in Feb.

I would like to know if I can apply for H4 to H1B transfer in cap exempt in I can find an employer?
