H4 visa for child born in USA

    Hi,

    My child was born in the USA but we have registered her birth with the Indian consulate and obtained an Indian passport from the consulate. She is an Indian citizen even though she was born in US.
    We are planning to travel to India on vacation soon and need to apply for H4 visa for our daughter to bring her back to the US with us. Both my spouse and I are on H1 visas.
    Will there be any issues with applying for h4 visa for her since she holds an US birth certificate?
    If there will be issues, how else can she travel with us to the US?
    We do not want to surrender her Indian passport.

    There will absolutely be no issues. In fact the consular officer will be pleased to see that inspite of being born in US, you have opted Indian citizenship for your child. You will have to go through the process of making the appointment and convincing the officer on the usual requirements of H4 visa.

        Hello h42006,

        I see that this is a very old thread but found while googling. Even i'm exactly in same position. I'm expecting father in US on H1/H4 VISA and will be applying for Indian Passport for my kid. Did you face any issues in getting dependent H4 visa for you're kid?

          The opinion on this thread is completely incorrect. A US born child is always considered a US citizen by the US govt and cannot be issued a visa.
