Hi,

I came to US with my wife and son in 2012. We found company who got ready to file H1 for my wife in 2013 for 2014 quota. They filed it and it got approved. Unfortunately, she did not get the job and went India for H4 stamping after 5 months. Meanwhile employer revoked the H1. Now my wife got H4 stamped and in US, Can we use previous employer H1B for H1B transfer ( as cap excempt) or we have to file new H1B

please tellme wen u went to india for h4 stamping, did u mention in previous employment u had in USA? did they ask about usa paystub??
did u resign in usa first then went for stamping? or we can go for stamping directly then resign
