  • Trick to get duplicate I 797 - Submitting USCIS form for Non-Delivery of Notice

Note: Pardon me, in case it might look like funny to play with USCIS

My H1b petitioner(future employer 'A') is not going ahead with the process after H1b Approval because the position no more exists.
I have only receipt number with me(checked the USCIS website that its approved, but no where it is mentioned/suggested that this is mine) and nothing else. Suppose I want to apply for H1b transfer to company 'B', they will most likely ask for proof(I-797).

Would you suggest me to fill the below form to get the Approval notice (I-797) by USCIS to my cousin's address in US without telling the 'A' (of my intention/trick)
    USING https://egov.uscis.gov/e-request/dis...roPageType=ndn

If yes, then I have few open questions :
I dont have clue of 'A-Number'
And In 'Applicant or Petitioner Information' will enter applicant's(spouse) details.
I think, all other details to be filled in the form are easy and one can fill that easily

PS: I am asking this for my spouse case.

That may not work as you planned. You have to understand that you dont actually own the I797, the employer A does and the duplicate copy if any would have to be requested by the employer/their attorney and the duplicate copy would be sent to the employer's attorney's address.

This is my opinion not legal advice.
