H1B cap exempt case validity

I got my first petition in 2007 , which was valid up to 2009. I was in USA for 1 yrs from 2008 to 2009
Inn 2009 I transferred my petition from employer X to Y. Now my second petition was valid from 2009 to 2012.
No visa is stamped on this petition.
From 2009 I am working in India with different employer (other than x,Y) and want to apply for H1b Cap exempt case.
1>I am eligible for this case?
2>If yes how long(till which date) I can apply for cap exempt?
