Regarding H1 B cap exempt

I had a valid H1 B (through my current employer) stamped on May 2011, but didnt able to travel due to some personal reason.

Work Permit was valid from 01-Oct-2008 to 09-Sep-2011.

Visa Stamping done on 20-May 2011 and valid till 09-Sep-2011.


I would like to know if a fresh H1-B can be initiated without coming under the cap through the same employer (H1-B cap-exempt).

Please let me know the details asap.

It seems you filed in 2009 cap so you may still be eligible. Check with your attorney.
