Hello,
My wife H1B is in RFE and I want to apply for H4 for her and she is currently on F1. Her semester is getting done next month. Will there be any issue if I apply for H4 even though her H1b application is still in RFE process. we are not going to answer the RFE. How long does the H4 application process take and she won't be out of status during this adjustment of status time period right ?
Has anyone had similar kind of situation before. Please advise.
