I was on H1B visa in US from 2002-2009. I finished my 6 years in year 2008. My employer filed PERM labor & based on that I got extention till August 2010.
However, I quit my employer and USA in Jan 2010. MY latest I 797 has validity till August 2010 & I left US in Jan 2010.
My question is, if is it possible to use the left over period on I 797 (which is from Feb'2010 - Aug'2010) for H1B tranfer purpose?
Or in other words my 7 months on I 797 was un-used so can I use it to do H1B transfer if I find an employer?
I am now canadian Citizen & can come back to USA on TN visa. I will join some employer on TN visa ask him to process my Labor & I-140. As soon as I-140 is approved I will switch to H1B using left over period on I-797. In this case I can get extention of more than 1-2 years based on approved I-140.
