Hi,

My present company has filed H1B VISA and it is stamped. I worked in US for 2 months. Now returned to India. I need help with below,

1) Can I directly search job in US from India? And join US company/consultancy?
2) Will my present company cancel my VISA? As they initiated it for me?
3) If "YES" for question 1, then can you please tell me what would be the process?
4) If "YES" for question 2, then can I re-stamp my VISA with another US employer?

You need to find any employer who can transfer ur H1 (Basically to apply a new H1 petition based on already approved Petition). Premium processing would be an ideal option. Hope you have not maxed out your H1 6 years period (You have not provided your petition and visa validity date)

2. If your visa on passport still valid, you don't have to go for a fresh stamping and can enter the country with your new 1797 petition and existing visa stamped on the passport. (Yes, though it has your old employer name on it)

Hi, Thanks for your valuable reply. My visa is valid till 2016 year end. I travelled US once for 2 months.

Do I need to find Indian employer to transfer my visa or us consultancy/company can do that. And one more, can my present employer cancel my visa or petition.

Its upto you but any employer can transfer the petition. Your current employer may cancel the petition but it wont impact you.

If my VISA/Petition is canceled then how how can I go. How it won't impact me. Is there any provision for such cases.

Visa/Petition are two different thing.

Your employer may revoke the petition but they cannot cancel your visa. Don't give your passport to them and Be careful on that.

You can travel with your newly approved petition and the existing valid stamped visa on the passport to enter into the country.

first u search for an US company who will hire u for job..then ask them to transfer ur visa to their name..when this transfer process is complete, u can stamped a new visa with their name and travel

Hi,

I heard, my present employervisa can revoke my VISA. I am getting confused. What are the rights to my current employer and me. What they can do and will it really stop me for doing job in US with direct US consultancy/company.

What are the chances of getting H1B rejection during VISA or Petition transfer? How many times we can transfer VISA.
