221(g), reaffirmed, cap-exempt

Hi,

I had my H1B visa interview during Feb 2007 and i was given 221(g) and the case was referred back to USCIS.
The USCIS reaffirmed the petition during Sep 2007. For some unknown reasons my employer was not ready to process the reaffirmed petition.

Am i eligible for a cap-exempt H1B petition now.
