Question regarding clock reset criteria (L1+H1 visa)
Hi,
I first came to USA on L1B visa on JUL-2009 and stayed till OCT-2011(833 days), then went to vacation for a month and came back on 28-NOV-2011 on same L1B visa and then stayed till 01-FEB-2013(432 days).
On 01-FEB-2013 I had to go back to India as my L1B got denied. In the same year on 01-APR-2013 my company applied for H1B visa which was selected in lottery and I got my H1B petition on 01-OCT-2013, I got the H1B visa stamped on 05-DEC-2013 which is valid till 05-SEP 2016.
Now I waited to complete my 365 days outside USA so that my clock reset and I can stay on H1B for full 6 years, keeping this in mind I came to USA on H1B on MAR-2014,completing 401 days before entering USA.
My question is that as I have traveled to USA after completion of more than 365 days on a fresh H1, will that reset my clock giving me full 6 year tenure on H1B or I will get 6yrs minus previous stay on L1, as my H1 was applied before completion of one year in APR-2013 and petition got approved on 01-OCT-2013.
Please suggest in my case whether I have full 6 years of stay or 6yrs minus previous stay on L1?
