I had an I79 from my employer starting valid from 6/12/2012 to 6/11/2015. I am in USA and did not travel outside the country so I do not have a H1B visa stamped on my passport. I was with a different employer before this where I had a I797 with a H1B visa stamped until 30 June 2012. My new job started on 1st July 2012 so I have no breaks in between.
The employer who I am currently working under applied for a new I797 which was approved and the valid date is 6/12/15 to 6/11/18. I have to travel to India due to to my father's sudden demise. I filled the DS 160 formed with the new I 797 with the new approval number.
My questions are a. Since I do not have an H1B visa stamped with my old I 797, will they give me a H1B stamp unto 6/11/18 and let me travel back before the validity start date of the new I797
b. Should I have put the old I 797 in the DS 160, and gotten a H1B valid till 6/11/2015 even though they would have the new I797 information in the system.
Please advice me.
