My 6 years H1b visa will max out in March 2016 and I'm on my last extension and have not been to India since the last extension. I am required to go to India in the month of Oct/Nov 2015 for a family wedding. Though my PERM (GC) is applied, but I might barely have my I-140 approved by then even in premium processing. So, my concerns are:
1. Is it OK to get my visa stamped in Oct/Nov prior to 4 months of 6 yrs max out? Since my extension on I-140 won't be filed till I get back to the US, will US consulate grant me visa stamping knowing I would be maxing out in 4 months?
2. If there is no risk involved in point (1), will I have any problem in getting into POE knowing I just have 3 more months to max out even though I give a justification that my H1b extension will be applied on approved I-140 once i get back?
