  • H4 Visa Drop Box eligability

    Hi,

I have question on H4 visa eligibility,

I have yes to all below questions except the 7th one, is this applicable to H4. what is H means here ? is this only H1B or applicable during H4 application; all the other statement in this question is Yes to me but confused about H.

    7) If I am applying for an H or L (individual) visa, my prior visa in the same classification with the same petitioner is still valid or expired within the last 12 months. Note:
L (Blanket) visa does not qualify.

    1) I received my visa after November 1, 2008
    2) I have a previous U.S. visa in the same class as the visa for which I wish to renew
    3) My previous visa was issued in India
    4) My most recent visa (in the same visa class for which I am applying) was issued on or after my 14th birthday
    5) I have no refusals for a visa in any category after my most recent visa issuance
    6) If I am applying for a B1/B2, C1D, F, or J visa, my prior visa in the same classification is still valid or expired within the last 48 months
    7) If I am applying for an H or L (individual) visa, my prior visa in the same classification with the same petitioner is still valid or expired within the last 12 months. Note:
L (Blanket) visa does not qualify.
    8) My prior visa is not annotated “Clearance Received”
    9) My most recent visa (in the same visa class for which I am applying) was not lost or stolen

It applies to H4 too. If H1 has changed employer then H4 not eligible for drop box.

This is my opinion not legal advice.

@ Anoopp - So what ended up happening? Did your spouse get h4 visa through drop box or had to go for interview? I am wondering in the same way about condition # 7.
