Hi Everyone,
I have a valid H1B, which will expire this year(2015), I am looking for H1B transfer. I never been to US. My visa expire soon so If any employer ready to apply for fresh petition(for 2015 cap), am I eligible to apply fresh H1B as I am holding valid H1B visa ?
Reason for applying fresh H1B visa:
1. Employer A applied visa for me , they are not sending me to US, so If I resign they may invalidate my visa so I am looking for fresh petition.
2. I hear that if new employer file a petition for H1B tranfer then previous employer can not be able to invalidate my visa(If we get H1B transfer petition approved notice from USCIS ), is that right ?
