Laid off on h1b now filing h4

I got laid off on h1b this month and has another job offer in process. But new employer is taking lot of time to process offer letter and all. meanwhile I have decided to file for COS to h4 this week. So that I will have something filed with USCIS within 30 days of my unemployment.

My question is what happens if new employer sends my h1b petition while my h4 is already in pipeline?
Any help from experts here ?

What is your visa validity? Do you have an option to go out of country until your new H1 transfer petition approved?
