    Hi,
    On May 30, 2008, my Form I-129, Petition for a Nonimmigrant Worker was approved but i was not able to go for stamping since due to recession my company got closed.
    Can i use this approval for a new cap-exempt H1B in 2015 Or do i need to re-apply fresh for the H1B visa.
    Your response will be very much appreciated.

      I believe you no longer are cap exempt as 2008 petition is over 6 Year old one and would need to re apply fresh.

      But first, have you found an employer willing to employ you? If yes, isn't their lawyer able to confirm if you are cap exempt or not, if no, then first thing you need to do is find an employer.
