I am in H1B (Full time in Top Banking company) valid till 2017. I recently got married in India and got the H4 stamped for my wife.
She is still India and will be travelling to USA by Mid April 2015. Since she has approx 4.5 yrs of IT experience, I reached out to a consultant to find out
if they can sponsor her H1B. The consultant says - "Since She will be in India when her H1B petition is filed (i.e 1st week of April) and after the petition approval,
they need to file a COS from H4 to H1 (as she would have entered in USA in her H4 during that time).
So basically they'll have to spend twice in her case (2 X $4500 = $ 9000 (approx) ). I was just trying to verify if this is correct ?
Anyone experienced similar situation or any suggestions will appreciated.
