  • unused vacation leave

    Hello,

I resigned from my previous H1B employer as I got a better job. My supervisor was pissed off (since I only gave two weeks in advance notice) and when I reported my vacation leave usages I accrued a lot of unused vacation days. What if my employer doesn't want to pay my unused vacation leave. Our rule is that unused vacation leave must be paid ASAP, at least on the next pay period. Am I protected by H1B ruling on benefits.

    Thanks.

Yes, you should be paid for your unused vacations. Check the section on paid vacations on your offer letter. Dont give in to your ex-employer demands. Legal action may be an option if it isnt paid. Why dont you check with your new employer's attorney?
