I got H!B approval notice from my Consultant in 2008 but I have not attended for H1B visa stamping in consulate. The validity of the H1B notice expired in October 2011.
My consultant told that the petition can be reopened by paying 3500$ to USCIS and can again attend the interview in consulate.
I want to understand the risks factors involved in this process. Are there any chances that it could be rejected?
The approval of visa will depend on the H1B cap this year??
Or is it better to go with new H1B process (lottery process)?
