  • Urgent help needed- h1b transfer after layoff

    Hi,

Appreciate your feedback on my situation below.

I got laid off, my last day was march 6th 2015. Now I was able to find the new employer who filed my h1b transfer and extension status under the premium processing on feb 27th 2015. I am still waiting for the receipt from the USCIS and hence currently not working.

    Below are my questions-

    - Does it usually take so long to get the receipt? previously attorney was able to get the receipt in 2 days over the email. It was filed in VST center.

    - Will I be ok given my visa is filed before my last day. will i be out of status till the time i join the new employer? and will this create problem in my visa approval.

Please help and post your experience.

Not at all and you are in a good direction. Just hold on for a few more days and eventually you will get your petition approved soon.

I would recommend not to join the new employer based on the receipt notice and wait for the decision to proceed further. Anyhow you should get your decision in 15 days as you have applied in premium mode. Best wishes!!

    This is my opinion.
