I had some concerns regarding what are the next steps in order to basically start working again for my new employer asap.
Here is the timeline of events,
Jan 30 layoff
Feb 5 COS to H4 (uscis receipt date Feb 9)
Feb 6 Last regular pay stub
Feb 18 New offer
Mar 5 LCA approved
The attorney with the new firm is also trying to figure out the 'lawful' and 'textbook' rule to get the petition going.
My question is should this be treated as h1b transfer or h4 to h1b? H4 is pending and all I have is the receipt saying that application was received. I did everything I could timely and I am hoping to start working ASAP without having to make a trip home and back with visa stamp.
