Do we need the photos of US company?

My Brother In Law is going for H1 stamping in Auckland New Zealand on 23rd Dec.
I have following questions.

1. Is it compulsory to take US company's photos?
2. The salary mentioned in the letter is $40K. Is that an issue?

Any response will be a real great help.

2. it depends upon the place. As long as the salary is market rate, it's fine.

I know one of my friend has the same kind of salary and he had no problems getting an H-1 stamp. But I will highly recommend the company photos...they do ask for it sometimes and you don't wanna be in situation where they ask you for something you don't have.....

THIS IS DEPENDANT ON THE PLACE WORK IN THE USA. CHECK IF THIS MATCHES WITH PREVAILING WAGE FOR THE COUNTY / CITY WHERE THE JOB IS OFFERED. IT SHOULD BE EQUAL OR GREATER.
