This is an awesome site... perhaps some one could help me with my present dilemma.
I arrived in US after marriage on H4 visa (Passport I-94 says H4 expiration date or something like that is Oct 2005). Some months later I applied and got F1 visa, completed studies and present employer sponsored H1 visa so I could work for the company.
Now I have never left country so all I have are my approval notices for the F1 and H1 . According to my present H1 approval notice my visa is valid from August 2003 to August 2006.
My GC lawyer applied for LC and its been over a year and half but no word on that yet.
Problem:
My GC lawyer maintains my 6th year H limit is based on my husbands Oct 2005 date because all my visa changes were only 'status changes' and not a real visa etc...
If this is true, I am in trouble cos I did not apply for extension this past October.
Another lawyer i spoke to doesnt think this is a big deal. After all my latest approval notice says I have a valid status until August 2006.
Who is right and what should be my next step be? I really appreciate anyone that can throw light on this issue.... thanks again!
