H1B Stamping after the expiration of current petition
I have valid H1B petition till 30-Sep-2015. I have came to US on 22-Nov-2012 and going back on 3-May-2015. I will not apply for extension due to some family reasons.
Now, my question is:
1) If I would like apply for H1B through my current employer or new employer, can my existing petition be used for cap exemption? Or still I have to go through the lottery?
2) If I get cap exemption, what are the chances of getting the H1B (considering employer will file through good attorney).
3) What duration would I get for the new H1B ?
